Cancellation Policy

SMITHMORE CASTLE – TERMS & CONDITIONS NO REFUNDS UNDER ANY CIRCUMSTANCES Binding Contract Upon Acceptance Smithmore Castle LLC (“Owner”) issues these Terms with every itinerary. If Guest asserts they did not know or agree, Guest is granted a one-time 72-hour right to cancel from receipt of these Terms, subject only to a 3.5% processing fee. After 72 hours, ALL PAYMENTS ARE 100% NON-REFUNDABLE. Continuing the booking constitutes full, voluntary acceptance. 1. Entire Agreement This is the complete agreement. No oral statements apply. Modifications must be in a signed writing by Owner and Guest. 2. No Refunds; Limited Credit All payments are NON-REFUNDABLE, NON-DISPUTABLE. • Cancellation >15 days before check-in: one-time 6-month credit (subject to availability). • ≤15 days: no credit. Chargebacks breach this Agreement and trigger Section 11. 3. Lost Property Owner is not responsible for lost, stolen, or misplaced items. 4. Release & Assumption of Risk Guest releases Owner from all claims (injury, property damage, negligence, vendors, weather, wildlife, activities) and assumes all risks inherent to a historic mountain estate. 5. Covenant Not to Sue Guest agrees not to sue, file complaints, or chargebacks. If violated, Owner is entitled to dismissal, all fees and costs, and $5,000 liquidated damages, enforceable under NC law. 6. Indemnification Guest indemnifies Owner for claims arising from Guest, invitees, vendors, conduct, defamation, or breach. 7. Voluntary Execution Guest affirms no duress and opportunity to seek counsel. 8. Overage Charges $500 per hour (or portion) beyond contracted time. 9. Media Rights Owner may use non-commercial photos/video taken on premises. 10. Safety Revocation Owner may halt or cancel for safety/emergency reasons. No refunds. 11. Fee-Shifting & Chargeback Penalties Any dispute or chargeback triggers all fees, costs, and $5,000 liquidated damages. 12. Furniture & Décor No moving or altering. Automatic forfeiture of security deposit. 13. Acts of God No liability for weather, outages, pandemics, or uncontrollable events. 14. Mediation & Arbitration Mandatory mediation in Mitchell County, NC, then binding arbitration. No jury. 15. Social Media & Defamation No defamatory or disparaging statements. Breach triggers damages, injunction, and fees. 16. Slip-and-Fall Waiver All such risks are Guest’s sole responsibility. 17. Vendors Owner not liable for third-party vendors. 18.
